1. Agreement

These Terms and Conditions ("Terms") govern your access to and use of modulon.dev, apps.modulon.dev, and related software, chat, and support services operated by BlurpleTech Inc. ("Modulon", "we", "us"). By using the service, you agree to these Terms.

2. Eligibility and account responsibility

  • You must meet all legal requirements in your jurisdiction to use the service.
  • For chat features that require an age confirmation, you must be at least 14 years old.
  • You are responsible for activity from your usernames, devices, recovery keys, and sessions.
  • You must keep recovery keys and any account credentials secure and private.

3. Chat, rooms, and moderation

Modulon Chat may include public rooms, invite-only rooms, and secure rooms. Public and invite-only rooms may be moderated for safety, abuse prevention, and service integrity.

  • Public and invite-only rooms: content and metadata may be processed to operate, moderate, and secure the service.
  • Secure rooms: depending on architecture and key state, we may have limited or no practical ability to read message content.
  • No guarantee of anonymity: you remain legally responsible for everything you send.
  • Enforcement: we may remove content, rate-limit, suspend, ban, or terminate access to protect users and infrastructure.

4. Acceptable use and anti-abuse

You agree not to:

  • use bots, scripts, or automation to spam, flood, scrape, or interfere with service operations;
  • attempt denial-of-service behavior, resource exhaustion, or abusive traffic generation;
  • bypass security controls, moderation, room limits, operator limits, or rate limits;
  • impersonate others, evade bans, or attempt unauthorized access to accounts, rooms, or infrastructure;
  • transmit malware, exploit code, or harmful content;
  • use the service for illegal activity, including fraud, exploitation, threats, or violence planning.

We may investigate abuse, preserve relevant logs and records we control, and cooperate with valid legal requests.

5. Purchases and licensing

Paid products are licensed, not sold, under the applicable license terms and product descriptions. Unless otherwise stated on the product page:

  • licenses are one-time purchases (not subscriptions),
  • license scope is tied to the purchasing legal entity, and
  • updates are provided according to the product policy in effect at purchase time.

6. Service availability and changes

We may update, limit, or discontinue features at any time, including room behavior, anti-abuse controls, and experimental tools. We may also revise these Terms by publishing an updated version on this page.

7. Data lifecycle and minimization

Private and secure room content is intended to be ephemeral. When a private room is deleted, expires, or becomes empty, we purge room-scoped in-memory message/board/session state as part of normal service operation.

We also remove room-scoped recovery-claim records tied to closed private rooms. However, operational security, abuse-prevention, and infrastructure logs may be retained for legitimate legal and security purposes and are not treated as public room transcripts.

No internet service can guarantee absolute, forensic-grade erasure across every client device, network, proxy, or third-party system outside our direct control.

8. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLURPLETECH INC. IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICE.

10. Refunds

Refund eligibility is described in the Refund Policy. Approved refunds are returned to the original payment method.

11. Governing law

These Terms are governed by the laws of British Columbia, Canada, excluding conflict-of-law rules, unless mandatory local consumer law applies.
